Perfume to Sell? Not on eBay

EBay Inc. lost an appeals court bid to halt a ruling that ordered it to stop online sales of LVMH Moet Hennessy Louis Vuitton perfumes. This ruling prevents eBay, or anyone selling on eBay Worldwide from listing any perfume from these manufacturers unless they are an authorized dealer. 

This ruling even goes so far as to prevent consumers from selling perfume received as gifts.

A Paris appeals court upheld a 50,000-euro ($80,000) fine for each day that EBay allowed the sales to continue, LVMH said.

The order was part of a 40-million-euro verdict last week over claims that San Jose-based EBay didn't do enough to block the sale of fake goods

My opinion on this....

The ruling shows the World that eBay is not the only entity to make a few bad decisions.  Preventing knock offs and couterfit products from flooding the market is not eBay's job.  eBay does not sell anything listed on their venue. All these things have been argued in court before...

The point I am so confused about is how does a single sale from an end user/consumer effect the bottom line of any of these brands?

In my book, if a perfume or purse or anything is valuable enough for someone to sell on eBay, or to even think they should sell it on eBay if they did not want it as a gift, then this perceived value really increases the brand value.  It would be a simple matter for eBay to restrict the quantity sold for a single seller ID to X amount of units per year. 

Why in the World would French legal officials see it as piracy to sell a gift purchase of a single bottle of perfume?

People have asked why we do not have a forum, and to be frank, I never had a good answer.

With the amount of people following the Journal now, I thought it would be a good idea to test the waters and start an informal Network meeting place.

This place is called: Trading Assistant Journal Network

I set this up on Ning because they seem to have a lot of features not found on old style bulletin boards and forums.  If the Ning thing works, great, if not and we have interest, I will start a real hosted forum on one of my servers.

As many of you know, this site (Trading Assistant Journal) is hosted on the free WordPress.com platform.  This is where we started, and frankly I like it here.  I think we will stay on WordPress.com as long as we are welcome. Therefore, why not try a free forum to go along with our nice WordPress.com blog?

Ning does place Google adsence on the Trading Assistant Journal Network site, this is the tradeoff for free forums, and I do not see a dime from those adsence ad's.

I hope the Network will become a place of value to my readers, where they can post interesting and respectful information and share ideas with like minded people without fear of threads being removed for mentioning the wrong company, or for disagreeing with the moderator.  The only offences to cause a person or post being plucked, will be outright disrespect, foul language, or personal attacks on other members of the Network. None of us have time for these things.

So, take a look, give it a whirl, post a hello... If you like it, stay, if not... OK

There will never be any dues to join other than participating in the conversation...

I'll be happy to do it.  When you announce it, I want it to be made clear that I am only agreeing because Steve canceled.  The current and former membership still have questions, and deserve answers.  Since I am no longer a member through the actions of the existing Board of Directors, I am not bound by confidentiality, and will be happy to answer any questions regarding what happened up until my membership was removed on Monday.  I would certainly prefer that Steve participated, and if he changes his mind again and decides to participate, I will then leave it up to him whether I should participate or not.

I think Larry is indeed correct, the membership does deserve answers.

Since Larry was a member of both the Board of Directors and the Ethics Committee, I believe he can shed light on numerous topics which the rank and file members of the IMA have questions about.

Larry knows what happened, and when it happened.  I have spoken with Larry at length and find him to be an honest and above board individual who simply devoted a significant amount of time to do his share at the IMA.

His summary dismissal came after he purportedly brokered a deal in which all of the current board members, including himself, would resign and offer the membership a chance to elect a new board.  This deal was completely reversed without Larry's input or knowledge on Sunday, he resigned from the board but not the organization. The next day, Larry was removed without his consent from the organization as a whole, without a grievance or explanation.

It will certainly be interesting to hear what Larry Phillips has to say during next Saturday's eBay and Beyond Radio Show!

Breaking News – Internet Merchants Association President Backs Out of Confirmed Interview

As reported here on the Trading Assistant Journal, Steve Grossberg - President of the IMA, had agreed and confirmed with Dave White of the eBay and Beyond Internet Radio Program to an interview.  This interview was to occur next Saturday July 12, 2008.

Mr. Steve Grossberg, Internet Merchants Association President and Treasurer, has just informed the eBay and Beyond radio program of his decision to back out of this live radio talk show interview.  Dave White was notified of this decision via email and Dave has given the Trading Assistant Journal permission to reprint this short notice.

I am going to have to back out of this interview. Right now my time and energies are geared toward #1 my family, #2 my business, and #3 getting IMA moving forward. We already have an open dialouge and interactive dialouge in place for IMA members to voice their opinions and be heard.

As will be commented here and elsewhere, this is not an unexpected development.  I will say I think it is a mistake to back away from an opportunity to offer a different side of the story.  This is a move which would not have been deemed advisable by any top notch PR firm or advisor.

Mr. Grossberg's comment in the letter above, stating there is already a place for members to voice opinions seems very empty, especially if Mr. Grossberg himself will remove any members from the Association who dare to voice a differing or dissenting opinion from his own, as has been reported by numerous sources.

Dave White would like to extend an offer for any of the remaining members of the Board of Directors at the IMA to fill in for Mr. Steve Grossberg.  Former members of the Board or Ethics Committee are also welcome.  The show will still be scheduled and the topics will certainly center around the recent implosion of the IMA governing body.

IMA Membership Revoked – As WAS CEO Debbie Levitt Say's in blog post

While reportedly awaiting an apology from the BOD at the Internet Marketing Association to which she belonged, Debbie Levitt posted on her blog today that she has been summarily expelled from the IMA.

Without a warning first. Without any correspondence. Without any suggestions. Without a note from moderators.

Apparently Debbie received a partial refund via PayPal of her $599.00 Gold business membership package from the IMA. 

Readers will recall that Debbie Levitt of AS WAS became involved in a war of words between herself and IMA President Steve Grossberg on the IMA discussion forums.  Both sides report issues such as slander and IMA rules violations and it is our understanding that both parties were suspended from posting on the discussion forum for a period of days.  We know from Debbie Levitt's blog that she apologized for her infraction but we have no reports of Mr. Grossberg following suit.

Debbie Levitt is claiming several instances of slander and damage to her professional stature, she is indicating she will pursue legal remedy for same. 

On another note, a former board member at IMA recently posted a comment on the Trading Assistant Journal which indicated she advised the board to secure insurance against such actions but she was ignored.  Exposure to action is one of the main detraction's from becoming a board member in any organization. If the organization does not protect itself, or its officers from litigation it has been reported by other sources the legal exposure could reach personal and business assets.

We certainly hope the situation will not reach this level of litigious action, but if the Florida Attorney General is called to investigate, one could only imagine the numerous civil suits which could follow.

IMA Members Filing Complaints Against Internet Merchants Association with Florida Attorney General Economic Crimes Division

A special meeting of the membership of the Internet Merchants Association was announced yesterday ( Sunday, July 6th, 2008 ). This meeting, called by and for the rank & file members of the association, scheduled to begin on July 10th, was to be held in a secure Internet conference format. 

According to the Association bylaws (as they existed at the time this meeting was called), there were no rules defined in the IMA rules to prevent a member meeting, special or otherwise, from taking place on the Internet or anywhere else.  The bylaws previously stated any meeting held must include attendance by 50% of the association membership, but the rules did not specifically preclude this or any meeting from occurring online.

That is, until late in the evening last night.

Apparently, from reports on this publication and others, the Board of Directors of the IMA called their own special meeting in the middle of last Sunday night.  In this special secret meeting of the BOD the rules for assembly were changed to prevent the aforementioned special meeting called by the membership from occurring.  Prior to last nights changing of the rules, the membership of the IMA could call a meeting anywhere, now after the changes made by three board members of the association, meetings must be held in person in the State of Florida.

Members of the IMA are concerned about a last minute change by the Board of Directors of the Internet Merchants Association of the Association bylaws apparently meant to prevent the membership from holding a meeting designed to be held on an Internet forum and presumably intended as a means to elect a new Board of Directors and President.

The membership believed the bylaws of the Association would allow such a meeting and that any new elections or actions which occurred during said meeting would be binding. This very well could have been true, until the rules were changed in the middle of the night.

The membership of the Internet Merchants Association reportedly live in several different States and countries. Presumably not all, or even half of the membership would not be available to travel to Florida for any special meeting held under circumstances of crisis such as has been recently reported at the IMA.

The latest reports and comments now openly call for the involvement of the Florida Attorney General in this matter.  Several members of the IMA have posted links and contact information for the Attorney Generals Offices in Florida, along with an outline of the basis of a complaint against the Board of Directors of the Internet Merchants Association. 

These members feel the last minute change of the bylaws, which now prevent the membership from meeting without the blessing of the BOD, has been an illegal act. Organizers of this official complaint want as many members of the IMA as possible to file complaints with the Economic Crimes Division of the Florida Attorney Generals Office in Tallahassee.

The primary complaint is that a Special Meeting was called by the membership to be held online, since IMA members are located throughout the US, Canada and the United Kingdom. After the meeting was announced, the Board of Directors changed the bylaws regarding where the meeting could be conducted, in an attempt to stop the meeting. Please note in your complaint that 3 of the 6 remaining Board of Directors resigned from the organization in the last 4 days.
